on 7 Oct 2016 National Commission Full Bench has given historical judgement in case no *97/2016*

All Flat buyer consumers can jointly file complaint under sec *12 (1)(c)* of CPA and ask relief from National Commission irrespective of cost of compensation and this case can be filed by consumer organisation like Akhil Bhartiya Grahak Panchayat.

*Case value is decided by adding Cost of flat+compensation demanded*

Once case has been filed as representative then other consumers can join this case as party and no separate case needs to file.

The judgement of forum/commission  is automatically apply to the other consumers if they apply afterwards.

Society or Apartment of association will not be in a position to file complaint as they are not direct consumer of builder but group of complainants can file the complaint with similar intrest though date of booking, amount is different.

So Akhil Bhartiya Grahak Panchayat is ready to file complaints if consumers approaches us and we will file representative case on behalf of all consumers.
